General Terms and Conditions (GTC)

1. Scope

These General Terms and Conditions (GTC) apply for all deliveries of Lutz Meinert (Madvedge Records) . (hereinafter: Madvedge) to consumers (§ 13 BGB). A consumer means every natural person who enters into a legal transaction for a purpose that is outside his trade, business or profession.

2. Contractors

3. Offer and Conclusion of Contract

3.1 The presentation of products in our online shop does not represent a binding offer, but an invitation to order. Errors and omissions excepted.

3.2 By clicking the [Order] button, you will place a binding order for the items listed on the order page. The purchase contract is concluded after we accepted your order by sending you an order confirmation via e-mail immediately after receiving your order.

4. Right of Revocation

4.1 Customers can revocate the purchase within a period of 14 days.

Revocation Policy

You can revocate the purchase within 14 days without giving reasons for the revocation. The revocation can be declared in text form (e. g. letter, fax, e-mail) or, if you receive the goods before the end of the 14 days period, by returning the goods. The revocation period starts after receipt of this instruction in text form, however not before receipt of the goods by the recipient (in case of recurring deliveries of similar goods not before receipt of the first partial delivery) and not before fulfilling our information obligations pursuant to Article 246 § 2 in connection with § 1 Sect. 1 and 2 of EGBGB and our obligations according to § 312e section 1 sentence 1 BGB in conjunction with Article 246 § 3 BGB. Consequences of Revocation

In case of an effective declaration of revocation the mutually received benefits are to be returned and any benefits (e.g. interest) are to be surrendered. In case you aren't able to return the items received as a whole and in a non-deteriorated condition, you will be charged a compensation for the value substitute. This does not apply if the deterioration of the goods is only a result of testing in a way that is similar to testing the goods at a store. In addition, you can avoid the obligation to pay compensation for a deterioration caused by a proper use of the goods by not using the goods as if they were your property and avoiding any use impairing their value. Transportable items are to be returned at our risk. You have to bear the costs of returning the goods if the goods delivered match your order and if their value does not exceed an amount of 40 euros or you did not yet provide full payment or contractually agreed partial payment at the time of declaring the revocation. Otherwise the return is free for you. Non-transportable items will be picked up by us. Obligations to reimburse payments must be fulfilled within 30 days. For you, the period starts when you effectively declare revocation, for us it starts when we receive the declaration or the returned goods.

End of revocation policy

4.2 The right of revocation does neither apply to goods having been produced according to customer specifications or explicitly to meet customer's personal needs nor for the delivery of audio or video recordings or software if the data media carrying these recordings or software have been unsealed by you.

4.3 Please return the goods in a postage paid package and keep the receipt. On request, we will refund the postage in advance unless it is to be borne by you.

4.4 Please give notice of the return by email. Thus we will be able to assign the returned products as fast as possible.

4.5 Please note that the procedures referred to in paragraphs 4.3 to 4.5 are not a prerequisite for the effective exercise of the right of revocation.

4.6 Return costs when claiming the right of withdrawal
When you claim your legal right of revocation (see revocation policy), you have to bear the costs of returning the goods if the goods delivered match your order and if their value does not exceed an amount of 40 € or you did not yet provide full payment or contractually agreed partial payment at the time of declaring the revocation. Otherwise the return is free for you.

5. Prices and Shipping Costs

5.1 The prices mentioned on the product pages include VAT and other price components.

5.2 The amount of shipping costs depends on the type of product and the place of delivery as indicated below:

Shipping of CDs and Mediabooks within Germany costs 2.70 €.
Shipping of Vinyl within Germany costs 5,99 €.

Shipping of CDs and Mediabooks outside Germany and within the European Union costs 7,39 €.
Shipping of Vinyl outside Germany and within the European Union costs 11,40 €.
Shipping of Vinyl to Switzerland and Great Britain costs 16,70 €.

Shipping of CDs and Mediabooks outside the European Union costs 12,89 €.
Shipping of Vinyl outside the European Union costs 19,90 €.

The shipping costs will be clearly indicated on the product pages, in the shopping cart system and on the order page.

6. Delivery

6.1 We use DHL as our delivery service.

6.2 Unless we provide an exact delivery date, information about delivery time is not binding.

7. Payment

7.1 Payment will be made either in advance or by cash on delivery.

7.2 With advance payment, we will provide our bank details in the order confirmation and will ship the goods immediately after receiving payment.

7.3 A right of set-off does only apply if your counterclaims have been legally established in court or are undisputed or acknowledged by us in writing.

7.4 You can only withhold payment if the claims result from the same contractual relationship.

8. Reservation of Oroprietary Rights

The goods will remain our property until full payment.

If you have found a product, you can put it in your cart by clicking on the button [Add to cart]. This does not cause a binding order. You can view the contents of the cart at any time by clicking the button [Shopping Cart]. You can remove items from the cart at any time by clicking the button [Remove]. If you want to buy the products in your cart, click the button [Order]. Please use the provided form to enter your data. The mandatory fields are marked with *. No registration is required. Your data is encrypted. After entering your information and selecting payment method you will be taken to the order page where you can check if your entries are correct and change them by clicking the button [Change]. By clicking the button [Order] the ordering process will be completed. The process can be interrupted at any time by closing the browser window. The ordering pages will provide more information, such as information how about to correct entries.

You will receive detailed information about your order and the GTC via e-mail. For security reasons, order informations will not be accessible over the internet any more after completing the order.
